The 2021 Fall Readiness Trials Presented by Redcon1 (the “Contest”) is sponsored by REDCON1, LLC (“Redcon1”) located at 701 Park of Commerce Blvd., Suite 101, Boca Raton, FL 33487. This Contest is open to United States of America (“US”) Citizens that reside in the US only (the “Contestant(s)”). This Contest is not open to residents of Rhode Island and void in any state where prohibited or restricted by law. By entering this Contest, the Contestant affirms that his/her/their participation in this Contest is permitted in the State or Territory that the Contestant resides.


Employees of Redcon1 (including any subsidiaries or affiliated entities of Redcon1) and/or their immediate family members as described herein are not eligible to participate in this Contest. Winners of previous Redcon1 Readiness Trials (or any other Redcon1 transformation contests regardless of the name) are not eligible to participate in this Contest. Athletes that are sponsored by other dietary supplement companies are not eligible to participate in this Contest.


WHAT CAN I WIN?


One Contestant (the “Winner”) will be selected for a chance to win the “Grand Prize” of FIFTY THOUSAND US Dollars ($50,000.00) and a one (1) year Athlete Agreement to be a sponsored Redcon1 Athlete. As part of the Athlete Agreement, the Winner will receive a monthly payment in an amount of FIVE HUNDRED US dollars ($500.00), FIVE HUNDRED US Dollars ($500.00) worth of Redcon1 products (supplements and apparel) per month (prices based off of the Redcon1 website without any promotions, deals or discounts) and be invited to travel with Redcon1 to certain events, as designated by Redcon1 in its sole discretion, to work the Redcon1 booth. The travel expenses will be paid or reimbursed to the winner by Redcon1 pursuant to the terms set forth in the Athlete Agreement. 


All prizes are valued in U.S. dollars. The prizes do not include taxes, insurance, personal expenses, gratuities, incidental charges, or any other items not specifically described in the Rules and the foregoing are the sole responsibility of Contestant. Contestants are responsible for determining applicability and payment of all federal, state and/or local taxes. In order to be a sponsored Redcon1 Athlete, the Winner will be required to sign an Athlete Agreement, separate and apart from these Official Rules. The Athlete Agreement will set forth the complete terms and conditions for being a Redcon1 sponsored Athlete. Contestant acknowledges and agrees that, if selected as the Winner, the Athlete Agreement must be executed prior to the Winner being a Redcon1 Sponsored Athlete.


WHO CAN ENTER?


Participation in this Contest is open to US Citizens residing in the US at the time of the Contest who are eighteen (18) years of age or older, or the age of majority in the Contestant’s home state. Contestants residing in Rhode Island are not eligible to enter this Contest.

 

By entering this Contest, the Contestant affirms that his/her/their participation in this Contest is permitted in the State or Territory that the Contestant resides. Contest agrees to indemnify, defend and hold-harmless Redcon1, its officers, directors, employees, agents, subsidiaries and affiliated entities from any claims that result from Contestant’s participation in this Contest in violation of their State’s laws, statutes or otherwise.


Employees, officers, members, sponsored athletes and agents of Redcon1 (including any subsidiaries or affiliated entities of Redcon1), their Immediate Family and persons living in the same household with any such individuals are not eligible to participate in this Contest. The term “Immediate Family Member” includes spouses, grandparents, parents, siblings, children and grandchildren. Contestant may not be a member of any guild, union, or other organization that may prohibit them from participating in this Contest and/or that would restrict, require due payment, or otherwise have the right to oppose such Contestant's participation in this Contest.


Winners of previous Redcon1 Readiness Trials (or any other Redcon1 transformation contests regardless of the name) are not eligible to participate in this Contest. 


Athletes that are sponsored by other dietary supplement companies are not eligible to participate in this Contest.


Only one (1) entry per person will be accepted. If a Contestant submits multiple entries, the last entry that is submitted will be accepted and any previous entries will be discarded.


In order to be eligible to win this Contest, Contestant must follow all of these Rules. Failure to comply with these Rules may result in ineligibility or disqualification of Contestant in Redcon1’s sole discretion. The most updated version of these Rules supersedes all previous rules, advertising, videos, marketing or other versions of these Rules. Any updates to these Rules will be reflected on this webpage. It is Contestant’s responsibility to check this Rules page for updates and to provide Redcon1 with accurate contact information for updates and communication regarding the Contest and these Rules. 


HOW DO I ENTER?


The Contest opens for submissions on Thursday September 2, 2021 and closes for submissions at 11:59:59 PM Pacific Time on Thursday September 16, 2021 (the “Submission Period”). 


In order to enter this Contest, Contestant must either: 

(1) Purchase ONE HUNDRED AND FIFTY US Dollars ($150.00)* worth of REDCON1 Products (Supplements and/or Apparel) from the Redcon1 website, www.redcon1.com, during the Submission Period AND add a free Entry Ticket to the cart at checkout; or 


(2) Purchase a Non-Discountable Entry Ticket in the amount of SEVENTY-FIVE US Dollars ($75.00)**.


* The $150.00 must be After any discounts and Before Shipping Costs.

** COUPON CODES, DISCOUNT CODES, GIFT CARDS, AND OTHER PROMOTIONS MAY NOT BE USED WHEN PURCHASING THE $75.00 ENTRY TICKET.


Contestant acknowledges and agrees that this Contest is not a Lottery, but is based on the skill and ability to make a transformation to his/her/their physique. This Contest is not based on luck or chance, accordingly Proof of Purchase is required.


Contestant must download and print a physical copy of a submission form (the “Submission Form”), which will be sent to the email address entered by Contest at checkout. Contest must complete the Submission Form and hold it in all of Contestant’s Before Photos. The Submission Form must include all of the required information.


Contestant must take four (4) Before Photos, (one from the Front, one facing the right side, one facing the left side and one from the Back) (“Before Photos”). Contestant should wear as little clothing as Contestant feels comfortable with, but in no event may the Contestant submit nude photographs. Submission of nude photographs will result in disqualification of Contestant. Contestant must submit the Submission Form, Proof of Purchase, and the Before Photos before 11:59:59 PM Pacific Time on Thursday September 16, 2021.


BEFORE PHOTOS MUST BE TAKEN HOLDING THE SUBMISSION FORM DISPLAYING THE DATE THE BEFORE PHOTOS WERE TAKEN. TIME STAMPS, PHOTOSHOP AND OTHER METHODS OF DISPLAYING THE DATE MAY NOT BE ACCEPTED. 


Contestant must submit weekly mandatory Check-In Photographs to transform@redcon1.com (“Weekly Check-Ins”). If Contestant misses more than one (1) Weekly Check-In during the Contest, Contestant will be disqualified. The Weekly Check-Ins consist of submitting four (4) photographs (one from the Front, one facing the right side, one facing the left side and one from the Back) displaying Contestant’s physique at that date. Contestant should wear as little clothing as Contestant feels comfortable with, but in no event may the Contestant submit nude photographs. Submission of nude photographs will result in disqualification of Contestant.


WEEKLY CHECK-INS MUST BE TAKEN HOLDING THE SUBMISSION FORM DISPLAYING THE DATE THE WEEKLY CHECK-IN WAS TAKEN. TIME STAMPS AND OTHER METHODS OF DISPLAYING THE DATE MAY NOT BE ACCEPTED.


EIGHT (8) weeks after Contestant submits his/her/their Before Photos, Contestant must take four (4) photographs, (one from the Front, one facing the right side, one facing the left side and one from the Back (“After Photos”) between Thursday October 28, 2021 and Thursday November 11, 2021. Contestant should wear as little clothing as Contestant feels comfortable with, but in no event may the Contestant submit nude photographs. Submission of nude photographs will result in disqualification of Contestant. Contestant must email the After Photos to transform@redcon1.com before 11:59:59 PM Pacific Time on the date that is eight (8) weeks from the date Contestant submitted his/her/their Before Photos. 


AFTER PHOTOS MUST BE TAKEN HOLDING THE SUBMISSION FORM DISPLAYING THE DATE THE AFTER PHOTOS WERE TAKEN. TIME STAMPS AND OTHER METHODS OF DISPLAYING THE DATE MAY NOT BE ACCEPTED.


The Contest shall end on Thursday November 11, 2021 at 11:59:59 PM Pacific Time (“End Date”).*


*Redcon1 reserves the right in its sole and exclusive discretion to extend the End Date. Any such extension will be communicated to Contestant via the email address submitted to Redcon1 with Contestant’s submission. Contestant is responsible for keeping his/her/their email address current and informing Redcon1 of any change to Contestant’s contact information by emailing transform@redcon1.com. 


Unless otherwise stated, all times and dates shall be based on US Pacific Time. To participate in the Contest, Contestant’s social media profiles must be publicly viewable for the duration of the Contest and Contestant must be registered to receive marketing emails from Redcon1. All final materials must be received on the End Date. In no event will final materials be accepted after Thursday November 11, 2021 at 11:59:59 PM Pacific Time. To enter the Contest, visit the website www.readinesstrials.com for the official Submission Form. Contestant must complete all information requested, including but not limited to, Contestant’s full legal name; full address (including apartment number, city, state, province, zip/postal code, and country); daytime, home, and/or mobile telephone numbers; email address; and date of birth. Failure of Contestant to correctly complete any portion of the Submission Form may result in ineligibility and/or disqualification. Any communication or updates regarding the Contest will be sent to Contestant’s e-mail address on file. It is Contestant’s responsibility to notify Redcon1 of any change to Contestant’s e-mail address by emailing transform@redcon1.com. All materials submitted, including but not limited to Before Photos, Weekly Check-In’s, After Photos and information entered on the Submission Form, shall become the property of Redcon1 and will not be returned to Contestant at the end of the Contest. False, deceptive, or incomplete entries provided by Contestant shall render the entry ineligible and, if discovered after the entry is submitted, will result in disqualification of the Contestant.


IMPORTANT NOTICE TO CONTESTANTS: CONTESTANTS ARE RESPONSIBLE FOR DETERMINING THE CORRESPONDING TIME ZONE IN THEIR RESPECTIVE JURISDICTION. REDCON1 WILL NOT BE HELD RESPONSIBLE FOR FAILURE TO SUBMIT REQUIRED MATERIALS WITHIN THE CORRECT TIME PERIOD.


Photo Submissions: Contestants are required to submit his/her/their Before Photos, Weekly Check-Ins, After Photos and Submission Form to transform@redcon1.com. Redcon1 reserves the right to contact any Contestant who has entered the Contest to request resubmission of one or more of the Before Photos, Weekly Check-Ins, and/or After Photos (collectively the “Images”) or to request that Contestant submit additional Images. Any entries submitted by anyone other than the person appearing in the Images, entries submitted by modeling agencies or other third parties, or Images that have been enhanced or altered will be rejected and result in disqualification of the Contestant. Submission of Images and entry in the Contest constitutes Contestant’s consent for Redcon1 to use the Images on Redcon1’s websites, associated or affiliated websites, social media accounts, marketing materials, and promotional materials in perpetuity without compensation and without prior notification or approval of any kind. Contestant represents and warrants that he/she/they has all rights to the Images and all materials submitted in connection with the Contest. Contestant grants Redcon1 a perpetual, royalty-free, non-exclusive, non-revocable, worldwide license to the Images and any materials submitted in connection with the Contest, and Contestant waives any claim he/she/they may have under any right of publicity statute in any State for Redcon1’s use of the Images. Redcon1 will decide, in its sole discretion, whether to accept Contestant’s Images or other submission materials. Redcon1 will not be responsible for any financial reimbursement to the original copyright holder for the right to publish the Images as provided herein. Redcon1 will not be held under any obligation to publish a photo credit to the original copyright holder for the publication of an Image. Contestant agrees to hold Redcon1 its officers, directors, employees, agents, subsidiaries and affiliated entities (collectively, “Redcon1”) harmless, defend, and indemnify Redcon1 from any and all liabilities, losses, claims, or causes of action, including reasonable attorneys’ fees and expenses, which may be incurred by Redcon1, arising out of or relating to the Images or any violation of the Rules. 




JUDGING


  1. The top contestants (“Finalists”) will be selected by a group of individuals chosen by Redcon1 in its sole discretion (the “Judges”). The Finalists will be selected based on criteria, including, but not limited to, (a) The physical improvement made to Contestant’s body as evidenced by the Before Photos, Weekly Check-Ins, and After Photos as submitted; (b) Contestant’s ability to achieve his/her/their transformation Goals; (c) Contestant’s use of REDCON1 products to achieve his/her/their transformation goals and; (d) Contestant’s adherence to all the Rules set forth herein. The Finalists will be notified by e-mail after the End Date, which will be announced on social media.

  1. A panel of Judges, which may include Redcon1 owners, founders, employees, athletes or individuals not affiliated with Redcon1 in Redcon1’s sole discretion, will select the Grand Prize winner from the Finalists. YouTube videos will not be used as part of the judging criteria. All decisions of Redcon1 and the Judges are final and binding in all matters related to the Contest. 

The official version of these Official Rules is the English language version. In the event of contradictions or discrepancies between different language versions or reproductions, if any exist, of these Official Rules are null and void and the English language version posted on www.readinesstrials.com shall control. Contestants must submit all materials and information in English. Redcon1 is not responsible for translation of any submissions or information provided in any other language. Failure to submit all required information in English may result in ineligibility and/or disqualification.


Personal Information: Any personal information submitted in connection with the Contest will be collected and used by Redcon1 to administer the Contest. Contestant’s personal information may also be used to send additional information and marketing about Redcon1, Redcon1’s products, Redcon1’s affiliated entities and licensees, in accordance with applicable law. Except as set forth herein, Contestant’s personal information will not be used for any other purpose and will not be shared with anyone else, unless required by law. 


RELEASE:  In consideration of the ability of Contestant to apply for entry in the Contest and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Contestant hereby takes action for themselves, their executors, administrators, agents, representatives, spouse, children, heirs, next of kin, successors, and assigns, and acknowledges and agrees as follows: (a) to be bound by the Rules; (b) that participation in the Contest is voluntary; (c) Contestant is a US Citizen, residing in the US and the age of majority in Contestant’s place of residence at the time of entry; (d) Contestant is of sound mind and body and has not been advised otherwise by qualified medical person; (e) Contestant possesses all rights and faculties necessary to agree to these Rules; (f) Contestant certifies that he/she/they meets all eligibility requirements as set forth in the Rules, which Contestant warrants they have read, understand, and agree to; (g) certifies that all Images Contestant submits for the Contest will depict only Contestant, will not be altered in any manner whatsoever, will be owned by Contestant and not require the consent of any other third party rights holder; (h) Contestant is fully aware of and assumes the risk of illness, accidents, injury, death, personal injury, bodily harm, emotional stress, psychological harm, property damage and all dangers potentially arising from or in connection with participation in the Contest and does so free and voluntarily; (i) Contestant is fully aware that the results of the Contest are decided by the Judges in Redcon1’s sole discretion, understands Redcon1 and the Judges’ decisions are final and binding in all matters relating to the Contest and these Rules, and agrees not to contest or challenge such decision, nor Redcon1’s decisions in any and all matters relating to the Contest. Further, Contestant irrevocably grants to Redcon1 the right to edit, modify and/or publish and copyright the Images. Redcon1 does not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Grand Prize, including, without limitation, quality, merchantability and fitness for a particular purpose. 


DISCLAIMER AND LIMITATION OF LIABILITY:  By entering this Contest, Contestant agrees: (a) to release Redcon1, its officer, directors, employees, agents, subsidiaries and affiliated entities from all liability, loss, or damage arising out of or relating to the Contest, including with respect to the Contest, interpretation of these Rules, decisions by Redcon1 and the Judges, and Contestants’ acceptance and use/misuse of the Grand Prize, if applicable; (b) to be bound by these Rules; and (c) that Redcon1, its affiliates and licensees may use Contestant’s name(s), likeness, biographical information, social media username, the Images, personal information, and statements made by Contestant to Redcon1, the Submission(s) in whole or in part in any and all media for any purpose, including without limitation advertising and promotional purposes, as well as in, or in connection with the Contest and/or other promotions conducted by Redcon1, and information on the entry form for advertising and promotional purposes in all media now known or later developed, worldwide without additional compensation. Contestant irrevocably grants to Redcon1 the right, in its sole discretion, to edit, composite, morph, scan, duplicate, alter, publish, modify, copyright, or otherwise use each Submission for any purpose which Redcon1 deems necessary or desirable (including, without limitation, posting on its website and social media pages), and each Contestant irrevocably waives any and all rights Contestant may have therein. Redcon1 does not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability and fitness for a particular purpose. Redcon1 is not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to Contestant’s or any other persons’, computer relating to or resulting from participation in this Contest; inability to access the entry website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. Contestant agrees proof of entering information at website is not considered proof of delivery or receipt. All dates set forth in these Rules are approximate. NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT TO THE CONTRARY, REDCON1 SHALL NOT BE LIABLE TO CONTESTANT OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOST PROFITS), EVEN IF REDCON1 HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. REDCON1 RESERVES THE RIGHT TO TERMINATE, SUSPEND, WITHDRAW, OR AMEND THE CONTEST FOR ANY REASON. 


ADDITIONAL REQUIREMENTS: All Contestants agree to sign any documentation requested by Redcon1, including, without limitation, an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form and Athlete Contract if selected and upon presentation of said form(s) by Redcon1. If any document is returned to Redcon1 as undeliverable or if Redcon1 does not receive a response from any Contestant within seventy-two (72) hours of attempted notification, such Contestant may be disqualified and the Grand Prize may or may not be awarded to an alternate winner. Contestants may be required to participate in media coverage and/or events at Redcon1's request. Should the Contestant be unable or unwilling to fulfill the obligations outlined in these Official Rules, a substitute winner may be named.


Governing Law; Jurisdiction and Limitation of Liability: This Contest will be governed by and construed in accordance with the laws of the state of Florida, without regard to conflict of law principles. Any controversy arising under, in connection with or in any way relating to this Contest shall be resolved in the State or Federal Courts located in Palm Beach County, Florida. BY ENTERING THIS CONTEST, CONTESTANT WAIVES ANY AND ALL RIGHTS TO PARTICIPATE IN ANY CLASS ACTION CLAIM OR ANY OTHER CASE INVOLVING ANY PERSON OTHER THAN HIM/HERSELF. IN ANY EVENT, REDCON1 SHALL NOT BE HELD LIABLE FOR ANY AMOUNT GREATER THAN THE AMOUNT CONTESTANT SPENT TO ENTER THIS CONTEST.
